Trump lawyer tries to prevent use of materials found in Federal Bureau of Investigation raid

President Donald Trump and his longtime personal lawyer, Michael Cohen, asked a federal court in California on Friday evening to put Stormy Daniels' lawsuit against them on hold while the criminal investigation of Cohen proceeds in NY.

It was a balmy Friday in New York City, but Michael Cohen probably wasn't in a very bright mood.

The request is reportedly based on the recent raid of the home and hotel room of Trump's attorney, Michael Cohen.

The Friday motion said that because of that overlap, "Mr Cohen's Fifth Amendment rights may be adversely impacted if this case proceeds", a reference to the possibility that his testimony could be used by prosecutors to build a related criminal case against him.

Before the adjournment, lawyers for Trump and Cohen told a federal judge in NY that they believe some of the documents and devices seized from Cohen during an FBI raid are protected by attorney-client privilege, and they want a chance to review the material before prosecutors get to examine them.

The F.B.I. agents who raided the office and hotel of President Trump's lawyer on Monday were seeking all records related to the "Access Hollywood" tape in which Mr. Trump was heard making vulgar comments about women, according to three people who have been briefed on the contents of a federal search warrant. Federal prosecutors said they would wait to review the materials until then.

In any case, as previously reported, all seized materials are subject to review by a special "taint team" (make your own joke) to make sure they're not protected. But it is hard to extract Cohen from his work for Trump.

While Trump had the "utmost interest" in ensuring that the process of preserving attorney-client privilege was respected, so did the public - and anyone who has ever sought legal counsel, Hendon said.

Such an order would be sought to stop the government from using seized materials, according to a person familiar with the investigation.

Just because the prosecution appears to believe Trump and Cohen are co-conspirators, that doesn't necessarily mean that will be proven, but that scenario is "clearly being scrutinized", McCarthy said. Wood said the court would reconvene in the afternoon to discuss how to release transcripts of those discussions that redacted the names of people described as "innocent individuals".

Wood adjourned the hearing until Monday to give lawyers for Trump an opportunity to weigh in on the issue. Avenatti said he thinks that some of the documents obtained from the Cohen search relate to his client.

"T$3 he agenda comprised questions on how deniable cash payments were to be made to hackers who had worked in Europe under Kremlin direction against the CLINTON campaign and various contingencies for covering up these operations and Moscow's secret liaison with the TRUMP team more generally", the dossier says.

Public corruption prosecutors in the USA attorney's office in Manhattan are trying to determine, according to one person familiar with the investigation, if there was any fraud related to payments to McDougal and Clifford.
