India court rejects pleas for probe into judge BH Loya's death

The Supreme Court on Thursday dismissed pleas seeking an independent probe into the alleged mysterious death of special CBI judge BH Loya, saying that the judge died of natural causes, as it held that the petitions were moved by political rivals to settle scores which was a serious attempt to "scandalise the judiciary". While the BJP and the Congress were locked in a high-decibel back-and-forth over the Supreme Court's ruling, Rahul Gandhi took to Twitter to say: "Indians are deeply intelligent".

Another Union Minister Ravi Shankar Prasad said, "This case was not activated to serve the public interest but to serve the interests of Congress and damage the interests of BJP, our party president Amit Shah in particular". Amit Shah was discharged by a new judge, who said there wasn't enough evidence to merit a trial.

Reacting to the Supreme Court's verdict, Mumbai Congress President Sanjay Nirupam expressed his disappointment and said that the supreme court should have formed a committee to investigate this matter. The Manipur CM further maintained that the Congress party has always blamed Prime Minister Narendra Modi and his government for every issue, but the party never blamed their leaders for any the wrong doings when they were in power for the last five to 15 years. He added that the petitions were wrong as they unaware of the truth. "Business rivalries and political rivalries should be settled outside", the top court said. The conclusion of the discreet inquiry is that Judge Loya suffered a heart attack in the presence of his colleagues belonging to the judicial fraternity.

The court said that the conduct of the petitioners and the intervenors "scandalised the process of the court and prima facie constitutes criminal contempt".

The Congress on Thursday said that it was a sad letter day in the country's history and pitched for a fair probe into the matter.

"CPIL procured copies of judge Loya's ECG (electrocardiogram) and histopathology report and sent them to Dr (Upendra) Kaul".

Prashant Bhushan, a lawyer and one of the petitioners, said the Supreme Court ruling made for "a sad day for the Indian judiciary".

On the plea that the judicial officers have to be cross-examined, as there are inherent contradictions in their statements, the bench said when there is very little proof that they are conspirators in a murder, the court must stand by the statements of the judicial officers. "The BJP's attempts to make false political capital out of Supreme Court judgment must be condemned".

Earlier on December 1, 2014, Judge Loya died while he was attending the wedding of his friend's daughter in Nagpur.
