Now Spacey, 59, is due to be arraigned on a felony count of indecent assault and battery on January 7.

The man who accused Kevin Spacey of sexually assaulting him in a MA bar in July 2016, when he was 18 years old, told police that he filmed part of the incident, PEOPLE confirms.

He reportedly sent his girlfriend a Snapchat video during the encounter, but Spacey's attorney said it only shows someone's hand touching another person's shirt.

Kevin Spacey's lawyers tried - and failed - to block prosecutors from filing charges against the House of Cards star, arguing that sexual assault victims do not allow themsleves to be groped by a predator for a solid three minutes.

Spacey was charged with felony sexual assault in December, more than a year after the accuser's mother, Heather Unruh, went public with the allegation that Spacey had abused her son.

"[Unruh's son] said the whole thing was embarrassing and has not had a "profound emotional effect" on him", attending Trooper Gerald F. Donovan wrote in the official report.

"We're not afraid, not of what we said, not of what we did and we're still not afraid", Spacey said, ostensibly as Underwood.

Minutes after news of his arraignment broke, Spacey released a video titled "Let Me Be Frank" in which he reprised his Frank Underwood character after being fired from "House of Cards".

"If a woman who saw what happened didn't tell [the alleged victim] to run while Spacey got up to go to the bathroom, I don't even want to think about what would've happened", Unruh said a year ago when the accusation was made public.

In the video, Spacey dons a Christmas-themed apron and talks directly to the camera, just like he did on the series, which he was written out of in 2017 following allegations of sexual assault and harassment.

"Soon enough, you will know the full truth".

"You wouldn't believe the worst without evidence, would you?" he said in the video. Spacey also used the statement to disclose he is gay.

He seemed to be slipping seamlessly back into the role of Frank, the sociopathic central character of Netflix drama House of Cards who was instantly dropped from the final season following allegations of sexual assault made against the actor in October 2017. "You wouldn't rush to judgements without facts, would you?" However, "you and I both know it's never that simple, not in politics and not in life", the actor remarked.
